Terms of Service

These terms govern your use of K53 Academy, operated by K53 Academy.

1. Who we are

K53 Academy is operated by K53 Academy (“we”, “us”). Company details as required by section 43 of the Electronic Communications and Transactions Act are listed at the end of this page.

2. The service

We provide online preparation for the South African K53 learner’s licence test: practice questions, quick tests, timed official-style exams and video lessons. We are not affiliated with the Department of Transport or any licensing centre, and we do not issue licences. Passing our exams does not guarantee passing the official test.

3. Accounts and age

  • You need an account to use paid features. Keep your password private; you are responsible for activity on your account.
  • If you are under 18, a parent or guardian must consent to your use of the service and must make any purchase. We record the guardian’s name and email at signup and may contact them to confirm consent.
  • One account per person. We may suspend accounts that share access or attempt to copy the question bank.

4. Payments and access

  • Prices are in South African rand; we are not VAT registered, so no VAT is added. Each plan is a once-off purchase for a fixed period (7 or 30 days) with a fixed number of official exam credits. There are no subscriptions and no automatic renewals.
  • Access starts immediately after payment when you tick “start my access immediately” at checkout. Credits and access expire together at the end of the period; unused credits are not carried over.
  • Payments are processed by Paystack. We never see or store your card details.

5. Cancellations and refunds

Our refund policy forms part of these terms. In short: you have a 7-day cooling-off right under section 44 of the ECT Act unless you chose to start access immediately, in which case the purchase is final except where the law gives you a right to cancel. Nothing in these terms limits your rights under the Consumer Protection Act.

6. Acceptable use

  • The questions, explanations, videos and design are our copyright or used under licence. You may use them for your own study only.
  • No scraping, bulk downloading, reselling or sharing of content, and no attempts to bypass security or payment.

7. Availability and changes

We aim for the service to be available at all times but do not guarantee it. We may change content and features. If we withdraw the service during a paid period we will refund the unused part.

8. Liability

To the extent the law allows, our liability to you is limited to the amount you paid for the current plan. We are not liable for the outcome of your official test.

9. Privacy

Our privacy policy explains what personal information we collect and why, including that our database is hosted in the European Union.
